In these Terms and Conditions "we" and "us" means EST 1971, the Website Owner, and "you" means you the customer or site visitor.

Please read the Terms and Conditions carefully before placing any orders on www.est1971.orderspace.com.

These Terms and Conditions together with your order constitute the entire contract between us and you for the supply of products. No other Terms and Conditions will apply. The contract may not be altered unless agreed to by us in writing or via email.

From time to time we may change the Terms and Conditions on www.est1971.orderspace.com please make sure you have read our Terms and Conditions at the time of purchase.

GST

On all Australian orders, EST 1971 prices are inclusive of the 10% GST charge on purchases. On International Orders, no Australian GST is charged for the product; however, it is law that GST is applied to freight. All prices are shown on www.est1971.orderspace.com are inclusive of GST and a breakdown is provided within the checkout.

Currency

All prices shown are in Australian Dollars.

Colours

Please note that colours of products will sometimes vary depending on the quality and make of the computer systems or monitors they are being viewed on.

Order Acceptance

Once order placement has occurred, you are engaged in a contract that sees you accept the prices and descriptions of the items you have ordered. Once an order has been placed with www.est1971.orderspace.com, you will receive an email confirmation of your order. This email does not indicate acceptance of the order, it is simply a confirmation that we have received it.

Unless an order is cancelled by you - the buyer, the order acceptance does not occur until EST 1971 has emailed you informing you that your order has been dispatched. Once this has occurred, the sale contract has concluded.

If we are unable to obtain authorisation for payment or in the case where we may suspect fraudulent use of credit card – we reserve the right not to accept your order. We also reserve the right to not accept your order if certain shipping restrictions apply for the area of delivery, or if the item ordered is out or stock or withdrawn from sale for any particular reason.

Orders will be cancelled after 7 business days from the date of the order being invoiced if payment has not been made or payment remittance has not been supplied to EST 1971. 

Payment Information

Payment is made using Paypal or bank transfer. Payment will be processed as soon as your order has been submitted. In the event that your order cannot be filled – a refund for the full purchase amount will be processed immediately.

Delivery Information

Orders will be sent via Aus Post with the chosen services of Standard or Express. The delivery service must be advised within the notes section within the checkout and not advised after an order has been placed. Delivery costs will be applied at the time of invoicing and based on the weight of total goods. All orders will be dispatched upon remittance or receiving the funds within the advised EST 1971 bank account. 

Returns Information

Orders can not be returned due to change of mind. Returns will only be accepted if deemed faulty.

EST 1971 does not accept responsibility for any errors, or omissions in the site contents, although, EST 1971 will be pleased to correct any errors displayed on our web pages if advised of them. EST 1971 reserves the right to change or discontinue any aspect or feature of this website. EST 1971 intends to use royalty-free material for the site and not to use any copyrighted material. If this occurs, we will remove it. EST 1971 does not accept any liability for any loss or damage suffered (directly or indirectly) by making use of the site’s information. Nor can we guarantee that pages will display correctly in all web browsers or that the website will be online at all times. We cannot accept responsibility for events publicised on our site and we advise anyone planning to attend at an event listed to recheck details. EST 1971 cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may happen when accessing this website. With any Links posted, the onus is on the visitor and EST 1971 is not responsible in any way for any of their contents.

Legal Capacity to Transact

If you are under the age eighteen (18) years you CANNOT place orders with EST 1971. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. Should EST 1971 suffer any damage or other losses as a result of a transaction entered into by a minor, EST 1971 reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with EST 1971.

Our Liability

We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. Our maximum aggregate liability for any products supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the products(s) in question.

Credit Card Fraud

Whilst EST 1971's hosting provider Shopify employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, EST 1971 will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an un-authorised manner.

Force Mejeure

EST 1971 shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of EST 1971, and EST 1971 shall be entitled to a reasonable extension of time for the performance of such obligations.

Govering Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Victoria, Australia and shall be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.

Other Terms

Our website is provided in the state of Victoria, Australia and conditions of use are subject to Australian law which governs this User Agreement. We do not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances beyond of our control.
